Terms and conditions for iD4me Site

In these terms and conditions, references to “iD4me”, “we”, “use” and “our” refer to iD4me Pty Ltd (ABN 74632754726) of level 5 447 Collins Street Melbourne 3000 (Registered office) including its subsidiaries, its holding companies, or subsidiaries of such holding companies.

Please read these terms and conditions carefully as they apply to your use of this website including any content on it (the iD4me Site). By accessing or using the iD4me Site you agree to be bound by these terms and conditions.

We may revise these terms and conditions from time to time. We will display a notice on the iD4me Site indicating when any such revisions have been made. These terms and conditions were last updated on 11^th June 2024

If you do not agree to abide by these terms and conditions, including any revisions, do not use or access the iD4me Site. It is your responsibility to regularly review these terms and conditions.

Registration for iD4Me Find and other services

Certain areas and functions of the iD4me Site are only intended for access and use by user who have registered with us, and agreed to the terms and conditions for iD4me Find (iD4me Find Agreement) or otherwise entered into a separate agreement with us for use of our services.

You must not access any part of this website that is intended for access and use by registered users unless you have a current registration with us to do so.

We are under no obligation to accept the registration of any particular person as a user.

The use of any areas and functions of the iD4me Site that are only intended for access and use by a registered user are subject to the iD4me Agreement or other separate terms (as applicable). If there is any inconsistency between these terms and conditions and those agreements, those agreements will prevail to the extent of the inconsistency.

Licence to use the iD4me Site

The iD4Me Site is subject to copyright and other intellectual property rights.

You may be granted particular licence rights to use data sets that under the iD4me Find Agreement or a separate agreement you have entered into with us. Where that is the case, those other licence rights apply in addition to this provisions.

iD4me grants you a limited, non-transferable licence to access and use the iD4me Site solely for your personal use, and solely for purposes that are permitted by these terms and any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions (including any laws regarding the export of data or software to and from any relevant countries).

iD4me and its licensors retain all right, title, and interest in and to the iD4me Site, and nothing you do on or in relation to the iD4me Site will transfer any intellectual property rights to you or grant you any rights to exercise any intellectual property rights unless this is expressly stated.

You must not copy or republish any part of the iD4me Site.id4mereserves all rights not expressly granted under these terms and conditions.

Collection and use of personal information; marketing communications

We will collect your personal information where you register to use our services, and in other instances where you interact with us. We may also send marketing communications to registered users subject to the requirements of applicable laws. General

Any provision of these terms and conditions which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity or enforceability of the remainder of this Agreement is not affected.

These terms and conditions are governed by the laws of Victoria, Australia. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

These terms and conditions are the entire agreement between the parties about its subject matter and replaces all previous agreements, understandings, representations and warranties about that subject matter.

No waiver of a right or remedy under these terms and conditions is effective unless it is in writing and signed by the party granting it. It is only effective in the specific instance and for the specific purpose for which it is granted.

A single or partial exercise of a right or remedy under these terms and conditions does not prevent a further exercise of that or of any other right or remedy.

Failure to exercise or delay in exercising a right or remedy under these terms and conditions does not operate as a waiver or prevent further exercise of that or of any other right or remedy.

No rule of construction applies to the disadvantage of a party because that party was responsible for the preparation of these terms and conditions.

Terms and conditions for iD4me Find

These terms and conditions for the use of iD4me Find (hereafter the iD4me Find Agreement) apply to persons who apply for or who are registered users of the iD4me Find service, as offered by iD4me from time to time.

Please carefully read this iD4me Find Agreement as well as the iD4me Site terms and conditions and our privacy policy, before using our services.

1. Operation of iD4me Find Agreement
   • If there is any inconsistency between this iD4me Find Agreement and the iD4me Site terms and conditions and our privacy policy, this iD4me Find Agreement will prevail to the extent of the inconsistency.
2. Registering to access the iD4me Find service
   • In order to access and use the iD4me Find service you must register as a user with iD4me by submitting an application via the iD4me Site. iD4me is under no obligation to accept an application for registration as a user.
   • You may register for the iD4me Find service only for business or commercial purposes, and not for your own private or personal use. By completing the registration application form you warrant that you are registering for the iD4me Find service only for business or commercial purposes.
   • You must promptly notifyid4me of any changes to your registered details.id4meis not responsible for any loss or damage which may arise from your failure to provide current, accurate and complete registration details.
   • You are responsible for the security of your user name and password for the iD4me Find service. We may assume that anyone using your user name and password is authorised by you to do so. Unauthorised use of your user name and password will, under no circumstances, reduce your liability in connection with using the iD4me Find service. You must notify us immediately on becoming aware of any unauthorised use of your user name or password or of any other security breach in connection with the iD4me Find service.
   • Your right to access to the iD4me Find service is limited to one place of login per user. If someone logs in from elsewhere using your details, you will automatically be signed out of your account. 
3. Access to, and licence to use, the iD4me Find service
   • Where your application for registration is accepted by us, we will:
     • provide you with access to the iD4me Find service via the iD4me Site;
     • grant you a non-transferable, non-exclusive license to access our databases and the information contained in the databases in Australia and New Zealand only, and solely for the purpose of performing data verification, person, property and address location and related searches for commercial use only.
   • Access to the iD4me Find service and databases included as part of those services is licensed and not sold. We reserve all rights not expressly granted under this iD4me Find Agreement in relation to the iD4me Find service and databases included as part of those services.
   • If you require broader usage rights, you can contact us to discuss a separate licensing agreement.
   • You must not:
     • use automated programs or other data extraction systems to access the iD4me Find service without our prior written consent;
     • sublicense any of your rights under this iD4me Find Agreement;
     • use our databases and information to bother, stalk, harass, threaten or embarrass any individual;
     • use the iD4me Find service to look up celebrities or other public persons, or to locate individuals under the age of 18;
     • make any our databases and information available to third parties in a manner that allows such third parties to download, extract or access the our databases and information.
   • The iD4me Find service includes a maximum search limit of 800 searches per day (from 12:00am to 11:59pm), per account. If this limit is exceeded, access to the system will be temporarily blocked until the next 24 hour period.
4. Your general obligations
   • ​You must only use information obtained through your use of the iD4me Find service only for appropriate, legal purposes, and in compliance with all applicable laws and regulations.
   • All searches of our databases are tracked, and you consent to such tracking and to the provision of all information about your use of our databases to law enforcement and others as may be useful to respond to allegations that our service or information has been misused.
5. ​Misuse of our services
   • In the event that we suspect that the iD4me Find service, our databases or our information has been misused, we will contact law enforcement agencies (as appropriate) and will provide them with all data needed to conduct an investigation.
   • reserve the right to cancel or not offer our service to any user that we consider (acting reasonably) is using our services in breach of this iD4me Find Agreement.
6. Fees, invoicing and oaument
   • ​Fees for use of iD4me Find service are posted on the various search pages. You must pay to us the fees for your use of iD4me Find service at the times specified on those search pages.
   • We will issue invoices to you for the fees at or shortly after the completion of your searches of relevant databases via the iD4me Find service.
   • You agree to pay the fees associated with your use of the ID4ME.ME databases by providing us with a valid credit card or other agreed payment method. You hereby represent warrant that you are an authorised user of any credit card or other payment method provided.
   • We further reserve the right to suspend service to any delinquent account without notice.
   • If you have questions about our fees, please contact us before you complete any search.
   • You are responsible for, and must pay for, all use of the iD4me Find service made by individuals using your account.
7. Warranties and disclaimers; liability
   • ​Each party represents, warrants and undertakes that the execution of this iD4me Find Agreement has been duly authorised by all necessary corporate action, and that this agreement constitutes a valid and binding obligation enforceable against it in accordance with the terms of iD4me Find Agreement.
   • While we use reasonable efforts to deliver the information services to its customers, to compile information gathered from selected public records and other sources, and to provide a convenient and functional service, we do not guarantee that your requirements will be met, that the iD4me Find service is accurate or complete, or that your use of the iD4me Find service will be uninterrupted or error free.
   • In particular, the information made available via the iD4me Find service has been compiled from public records and other proprietary sources for the specific purposes of (1) locating individuals, property and businesses, and/or (2) providing general background information about individuals and businesses for verification purposes. Subject to clause 5, neither iD4me nor any of our data suppliers represents or warrants that the information is current, complete or accurate.
   • Subject to clause 5, the the iD4me Find service is provided “as is, as available” and iD4me excludes and disclaims to the maximum extent permitted by law all guarantees, conditions, warranties or terms of any kind, whether express or implied or imposed by any applicable law, including implied warranties of merchantability, non-infringement, title and fitness for a particular purpose.
   • Nothing in this iD4me Find Agreement excludes, restricts or modifies any guarantee, warranty, term or condition, right or remedy implied or imposed by any applicable law which cannot lawfully be excluded, restricted or modified.
   • If any guarantee, condition, warranty or term is implied or imposed by any applicable law and cannot be excluded (a Non-excludable Provision), and we are able to limit your remedy for a breach of the non-excludable provision, then our liability for breach of the Non-excludable Provision is limited exclusively (so far as applicable laws do not prohibit) to one or more of the following at our option:
     • in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; or
     • in the case of services, the supplying of the services again, or the payment of the cost of having the services supplied again.
   • Subject to clause 5, under no circumstances are we liable to you for any damages whatsoever, including (without limitation) any special, incidental, exemplary or consequential damages, loss of profits, revenue, business, goodwill, bargain, anticipated savings or management time , even if we have been advised of the possibility of such damages.
   • Subject to clause 5, and to the maximum extent permitted by law, our maximum aggregate liability for all claims under or relating to this agreement or its subject matter in any calendar month is limited to an amount equal to the fees paid by you under this agreement in that calendar month.
   • Our liability to you under or in relation to this iD4me find agreement or its subject matter is reduced to the extent that your acts or omissions, or those of a third party (other than our licensors or subcontractors), contribute to or cause any such liability.
   • The limitations and exclusions of liability in this clause 7 apply regardless of the basis on which such liability arises, whether in contract, breach of warranty, tort (including negligence), in equity, under statute, or under an indemnity.
8. Indemnification
   • You agree that you shall indemnify and hold harmless iD4me, its officers, directors, employees, and agents, and all entities that have contributed information or data to, or provided services, for the Service, against any and all direct or indirect losses, claims, demands, expenses (including attorneys' fees) or liabilities of whatever nature or kind arising in any way out of your use of the Service or of our databases or of the information and data contained therein in breach of this iD4me Agreement. We will promptly notify you of any such claim.
9. Communication
   • We primarily use email to communicate with its customers. All purchase receipts, confirmation notices, and welcome messages are delivered through electronic communications.
   • We may send alerts and notifications from time to time informing you of our services and special offers. If you wish to opt-out from receiving such communications, please send an email to accounts@iD4me.me
10. Account expiry
    • ​We reserve the right to suspend or delete any account which has not been used to log in for a period of 6 months or more. Any credit associated with such accounts is forfeited.
11. Termination
    • Either party may terminate this iD4me Find Agreement with immediate effect, by giving the other party notice of such termination, if the other party breaches any of its obligations under this Agreement.
    • You may terminate this iD4me Find Agreement by providing 30 days’ notice to iD4me.
    • We may cease providing the iD4me Find service at any time, in which case it may terminate this iD4Me Find Agreement with immediate effect by giving you notice of such termination.
    • Where this iD4me Find Agreement is terminated, the access and licence granted under clause 1 ceases immediately and you must immediately cease your use of the iD4me Find Service.
    • Where we terminate this iD4me Find Agreement, in whole or in part, in accordance with clause 3, we will provide to you a pro rata refund of any fees paid in advance.
    • Termination of this iD4me Find Agreement does not affect any accrued rights or remedies of either party.
12. General
    • Any provision of these terms and conditions which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity or enforceability of the remainder of this Agreement is not affected.
